I am by no means an attorney, But it seems you sent an email of a decal you had reproduced to a corporation that owns the name "Trans-Dapt" which is trade marked. The image on the decal you had reproduced is "dead" but the name "Trans-Dapt" however, is not. And reproducing the name "Trans-Dapt" without authorization for purpose of personal gain or any other reason constitutes trademark infringement, or, theft. And seeing how you sent the email after the decal was reproduced, without permission, it could be said you have stolen the trademark, because I didn't see anything in the reply that said you were given permission to do so, only that what you had sent, looked great and that he was forwarding the image to everyone. Am I missing something?

You wanting this Trans Dapt SAAPE Pit Bike decal because you had just purchased Bill Siples Powell Challenger 117-5 and it was believed to be a Trans Dapt Pit Bike.
You rushed me almost begging me to please send you the scan of the original Trans Dapt SAAPE decal I had just PURCHASED off ebay.
My only fault here was wanting 1 decal for the SAAPE bike I was restored..
A small price for supplying you with the original art work.
And I gladly complied with your request spending well over an hour uploading a 1200dpi scan of the original decal to your company's FTP server.
Your explanation for the rush was you had a deadline to meet and you were about to send Casey Davis's Briggs and Tecumseh art work to YOUR decal manufacture in hopes of have them ready for Windber 2012 where you were planning on selling them and you wanted to include the Trans Dapt SAAPE art work on this decal run most likely for a price break.
Paul do you remember who SHARED there original Briggs and Stratton decals with you?

It wasn't until we discovered that the Powell you purchase from Bill 117-5 was not a SAAPE.
In one of our conversations you said if 117-5 was not a Trans Dapt SAAPE then why would I make this decal.
I believe this is why you started backing out from making the Trans Dapt SAAPE decals.
And more importantly you did not want to spend additional money making this decal..
I would have understood and it would have ended there.
In the many conversations that we had you NEVER mentioned that you had contacting Marc Lewis Heddman...And that you were concerned about trademark infringements.
So I call you a lier in this open forum!
Months later after not having talked I receive by mail the original Briggs and Stratton decals I had provided you along with a 2 sets of your new decal and a hand written letter telling me you don't know what you did and that I choose to end our friendship.
I felt bad because at the bottom of your letter you said " For my part, although I'm not sure what I did, I'm sorry!"
I choose this opportunity call you one on one trying to patch things up between us.
In our conversation the SAAPE decal subject comes up i say to you how much would it cost to have this decal made you provide me with a price and I say if I send you the money will you have this made it is at this point that you mention your concerns about the trademark.
I then ask you for your source and like its some Top secret weapon you tell me you won't give that information to me or any one else we talk a bit longer and You tell me that you contacted Alan Powell and it was confirmed he and his brother would be at Funday.
We say good by no hard feelings.
I spend all of about 15 minutes doing an INTERNET search and what should pop up? ART DECAL.
End of story
Funday 3 I show up @ 5:30am no one else is anywhere in sight except Dave.
I help you open shop in my slippers no less and we laugh and move stuff around so you can get ready for the crowd that is expected.
Alan and Bradly Powell arrive I believe I was first to spot them so I take it upon myself to personally escort them.
And the very first person I introduce them to is YOU.
I remember walking with you and the brothers I turned to you made a comment saying how surprised I was that you had found Alan's contact info..

From the US trademark file looks like the Briggs & Stratton is verry much alive and also per BASCO website is the term Briggs & Stratton is a right reserved and cannnot be used without permission. Now im sure they are not worried about a few decals more so some company in China does not make parts with the name on it, BUT IT IS NOT LEGAL TO USE IT!

Minibikers/OldMiniBikes members need these vintage water slide decals. And those that have a little extra cash laying around and can afford to have them made should!! without fear of some hell bent and spiteful person calling the cops on them.
No one is going to rich from selling them..
What bothers me is when a member who has been making takes it upon themself and makes it their mission in live to call a company whos decal the oher member is making.
I consider this to be wrong and evil hearted...

I made a post several days ago after reading Don’s thread about his decal production and the objection by another OldMiniBikes member. At this point, I would agree with gumpit, “it seems like it will be best and only settled by the 2 involved. Note to self.... get both sides.....”
I meet and have gotten to know both of you guys during my short time with OldMiniBikes and have both respected and enjoyed the knowledge and confidence yall bring to our hobby. Both of you guys are very passionate about this hobby and I believe want it to be seen in the most positive light possible. I think over time, your disagreement will pass and yall will again find some value in each other’s contributions to mini biking. I plan to stay friends with both of yall for many years and hope that friendship is welcome. Guys, just be cool, everything works out over time and I think this probably will too. For now, maybe ya’ll should just agree to end this “discussion” and let’s move on to important things, ie. like finding and restoring more Powells, ha ha. I guess that last line was a little selfish on my part.
